Instinctiv Privacy Policy

Instinctiv, Inc. (“Instinctiv”) knows that you take your privacy seriously. We do, too. We are committed to giving you transparency of our privacy practices and control over your data in connection with Instinctiv’s Service (as defined in Instinctiv’s Terms of Service (currently located at http://instinctiv.com/legal/terms). To that end, in addition to these Terms of Service, we have developed this Privacy Policy to describe the data we collect, how we use it, with whom we share it, and your choices regarding your data.

This Privacy Policy covers Instinctiv’s treatment of personally identifiable information (“Personal Information”) and other data that Instinctiv gathers when you are accessing Instinctiv’s Service.

What Personal Information Does Instinctiv Collect?

Personal Information You Provide to Us: We receive and store any information you enter on our Service or provide to us in any other way and store all this information on encrypted servers. The types of Personal Information collected may include your name, email address and access third party services you authenticate through the Service.

The Personal Information you provide is used for such purposes as allowing you to set up a user account and profile that can be used to interact with other users through the Service, improving the content of the Service, customizing the advertising and content you see, and communicating with you about specials and new features.

Anonymous and Non-Personal Data:

Instinctiv will, from time to time, automatically collect information that can be used to identify media in your Instinctiv library on this computer, such as your play history, library contents and playlists and approximate location. This information will be stored anonymously and not associated with your name any other Personal Information. When you use the player, Instinctiv will use this information and the contents of your Instinctiv library, as well as other information, to give personalized recommendations to you.

Instinctiv may only use this information and combine it with aggregated information from the Instinctiv libraries of other users to:

  • Create personalized playlists for you from your Instinctiv library.
  • Provide you with recommendations regarding media and other products and services that you may wish to purchase or consume
  • Provide recommendations regarding products and services to other users.
  • Improve our ability to help you browse for content based on your demonstrated listening preferences

The Instinctiv Player will at times automatically compute and submit audio fingerprints and meta data to the Instinctiv database. The software can do this in such a way that any use of computer resources is negligible. Audio fingerprints and meta data do not contain any information about you or your computer, and do not violate any copyright laws. Nevertheless, if you do not wish to submit audio fingerprints or metadata, do not use Instinctiv software. We treat this data as non-Personal Information, except where we are required to do otherwise under applicable law. Instinctiv only uses this data in aggregate form. We may provide aggregate information to our partners about how our customers, collectively, use our site, so that our partners may also understand how often people use their services and our Service. This data is anonymized and encrypted to ensure your privacy.

How is My Information Shared? We neither rent nor sell your Personal Information to anyone. All data we receive is anonymous and encrypted we maintain each user’s privacy and anonymity through ensuring all data resides only on Instinctiv’s protected servers (which are under 24 hour guard and maintenance with backup power supplies). All non-Personal Data, including song meta data and audio fingerprints, are compiled and stored on encrypted servers as well and may be sold to third parties to improve their products and services. In the event non-Personal Data is shared, all characteristics of the data relating to the user are removed and not made available to third parties.

Sharing with Partners, in connection with business transfers, and for the protection of Instinctiv and others:

Our Partners: In addition to the data sharing described above, we enter into relationships with a variety of businesses and work closely with them. In certain situations, these businesses sell items or provide promotions to you through Instinctiv’s Service. In other situations, Instinctiv provides services, or sells products jointly with these businesses. You can easily recognize when one of these businesses is associated with your transaction, and we will share your Personal Information that is related to such transactions with that business, unless you have elected not to be solicited by marketing partners during the registration process or through the account settings page.

Business Transfers: If Instinctiv or its assets are acquired, or in the unlikely event that Instinctiv goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party.
